Demande unilat\u00e9rale<\/h2>\n\n\n\n

Cela fait des ann\u00e9es que les syndicats et la direction de Decathlon en Belgique, plus pr\u00e9cis\u00e9ment le centre de distribution du d\u00e9taillant sportif \u00e0 Willebroek, sont en conflit. Selon les syndicats, il n’y a pas de place pour le dialogue social, le personnel et les repr\u00e9sentants syndicaux sont intimid\u00e9s et des employ\u00e9s ont d\u00e9j\u00e0 \u00e9t\u00e9 licenci\u00e9s apr\u00e8s avoir particip\u00e9 \u00e0 des actions syndicales.<\/p>\n\n\n\n

L’ann\u00e9e pass\u00e9e, un nouveau conflit a \u00e9clat\u00e9 et la direction a demand\u00e9 unilat\u00e9ralement au tribunal de Malines de lever le blocus. Le tribunal a accept\u00e9 la demande, donnant \u00e9galement un exemple \u00e0 Delhaize, qui utilisera la m\u00eame technique pour briser les postes de gr\u00e8ve lors de la lutte contre le franchisage de la cha\u00eene. Dans certaines r\u00e9gions, le tribunal l’a autoris\u00e9, tandis que d’autres juges ont estim\u00e9 que les requ\u00eates unilat\u00e9rales n’\u00e9taient pas autoris\u00e9es.<\/p>\n\n\n\n

Le dialogue social est indispensable<\/h2>\n\n\n\n

Cependant, deux repr\u00e9sentants du Setca-BBTK ont fait appel et, cette fois, le tribunal civil de Malines s’est rang\u00e9 du c\u00f4t\u00e9 du syndicat<\/a>, rapporte La Libre. Le tribunal a d\u00e9clar\u00e9 que Decathlon aurait d\u00fb formuler une demande normale, et non unilat\u00e9rale. En outre, la direction aurait d\u00fb participer au dialogue social afin d’\u00e9viter une gr\u00e8ve. Ensemble avec le syndicat ACV, BBTK a d\u00e9pos\u00e9 une autre plainte p\u00e9nale en d\u00e9cembre concernant l’absence de concertation sociale chez Decathlon Belgium, mais cet affaire-l\u00e0 est toujours en cours.<\/p>\n\n\n\n

\u00ab\u00a0Ce jugement est une condamnation tacite de la direction de Decathlon Belgique et une victoire pour le droit de gr\u00e8ve\u00a0\u00bb, explique l’avocat Joris De Wortelaer.
