De rechter heeft die klacht echter verworpen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Testcase<\/h2>\n\n\n\n<p>Afgelopen voorjaar had de Federatie van Duitse Consumentenorganisaties (<em>Verbraucherzentrale Bundesverband<\/em>) Lidl <a href=\"https:\/\/www.retaildetail.be\/nl\/news\/food\/consumentenorganisatie-klaagt-lidl-plus-app-aan\/\">voor de rechtbank gedaagd<\/a> omdat de discounter klanten die zich registreren in de app onvoldoende zou informeren over het feit dat voor de kortingen en coupons die ze ontvangen, betalen met hun persoonlijke gegevens. Daarom mag Lidl de Plus app niet als \u201cgratis\u201d promoten, vonden ze: de retailer zou de \u201ctotaalprijs\u201d moeten vermelden.<\/p>\n\n\n\n<p>De rechtbank in Stuttgart is die redenering niet gevolgd: <a href=\"https:\/\/www.lebensmittelzeitung.net\/politik\/nachrichten\/grundsatzverfahren-verbraucherschuetzer-scheitern-mit-klage-gegen-lidl-plus-app-186730\">dinsdag wees ze de aanklacht af<\/a>. \u201cDe verplichting om een totale prijs te vermelden veronderstelt dat er \u00fcberhaupt een prijs moet worden betaald. Consumenten hoeven echter juist geen prijs te betalen voor het gebruik van de Lidl Plus-app\u201c, zegt het persbericht van de rechtbank. De Duitse en Europese wetgever gaan bij het begrip \u201dprijs&#8221; altijd uit van een te betalen geldbedrag.<\/p>\n\n\n\n<p>Dat is een opluchting, niet alleen voor Lidl maar ook voor collega-retailers: de zaak werd gezien als een testcase voor de klantenloyaliteitsprogramma\u2019s van andere retailers.
